1. Introduction

These Terms and Conditions govern the basis on which Payung Adil ("we", "us", "our", "the Firm") provides pension legal advisory and representation services to clients ("you", "the Client") through our office in Kuching, Sarawak, and through our website at payungadil.blog.

By engaging our services or submitting an enquiry through our website, you agree to be bound by these Terms. Please read them carefully. If anything is unclear, we welcome you to contact us before proceeding.

These Terms are governed by the laws of Malaysia. Payung Adil operates in compliance with the Legal Profession Act 1976 and the professional standards of the Advocates Association of Sarawak.

2. Our Services

Payung Adil offers the following pension legal services:

• Pension Understanding Session — A structured consultation to review your pension records and explain your entitlements in plain terms. This session is advisory only and does not constitute formal legal representation.
• Claim and Appeal Support — Assistance with delayed or contested pension claims, including preparation of correspondence, gathering of supporting evidence, and where appropriate, representation before relevant authorities.
• Complete Protection Package — A comprehensive service covering nominee arrangements, record organisation, and periodic reviews of your retirement provisions, with the option to include family members upon your written consent.

The scope of any engagement will be confirmed in a client engagement letter issued before work commences. Services outside the agreed scope require a separate written instruction.

3. Client Responsibilities

To enable us to assist you effectively, you agree to:

• Provide accurate, complete, and timely information relevant to your matter.
• Promptly notify us of any changes to your circumstances that may affect your pension entitlements or the progress of your matter.
• Attend scheduled appointments at the agreed time or provide reasonable advance notice of any change.
• Retain and produce original documents when requested, and to inform us of any documents that may be missing or unavailable.
• Settle invoices within the timeframe specified in your engagement letter.

We rely on the information you provide. We cannot be held responsible for outcomes arising from information that is inaccurate, incomplete, or withheld.

4. Fees and Payment

Our fees are set out in the engagement letter and on our website. Current service fees are:

All fees are quoted in Malaysian Ringgit (RM) and are inclusive of applicable taxes unless otherwise stated. Disbursements (such as official filing fees, courier charges, or third-party costs) will be charged separately and itemised in your invoice.

Payment is due within 14 days of invoice unless agreed otherwise in your engagement letter. We accept payment by bank transfer, cheque made payable to Payung Adil, or such other method as we may notify you.

If a matter proves more complex than initially anticipated, we will discuss any adjustment to fees with you before proceeding.

5. Confidentiality

All information you share with us is treated as strictly confidential and subject to legal professional privilege. We will not disclose your personal or matter-related information to any third party without your consent, except where we are required to do so by law or by a court of competent jurisdiction.

6. Limitation of Liability

We provide our services with reasonable skill and care. However, outcomes in legal and administrative matters before government pension authorities depend on factors outside our control, including the policies and decisions of those authorities, the completeness of records held by third parties, and applicable legislation that may change.

Our liability to you arising from any act or omission in connection with our services is limited to the fees paid for the specific service in question, except where liability cannot be excluded by law.

We are not liable for indirect or consequential losses, including loss of pension payments resulting from government decisions, third-party delays, or circumstances beyond our reasonable control.

7. Intellectual Property

All written materials, template documents, guides, and other materials produced by Payung Adil and delivered to you in the course of your engagement are provided for your personal use in connection with your pension matter only. They may not be reproduced, shared, or republished without our prior written consent.

8. Termination of Engagement

You may terminate your engagement with us at any time by giving written notice. Upon termination, you will be invoiced for work completed up to the date notice is received. We will promptly return original documents to you.

We may withdraw from an engagement in limited circumstances, including if we are unable to obtain necessary instructions from you, if a conflict of interest arises, or if continuation would place us in breach of our professional obligations. We will give reasonable advance notice where possible and assist with an orderly handover.

9. Use of Our Website

The information on our website is provided for general informational purposes only. It does not constitute legal advice and should not be relied upon as such. Pension rules and entitlements vary by individual circumstances; we recommend speaking with us directly before making any decision.

We take reasonable steps to keep the content of our website accurate and current, but we cannot warrant that information is complete, up to date, or free from error at all times.

10. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from or in connection with our services or these Terms shall first be referred to good-faith negotiation between the parties.

If the matter cannot be resolved through negotiation, it shall be subject to the exclusive jurisdiction of the courts of Malaysia, with venue in Kuching, Sarawak, unless another forum is required by applicable law.

11. Changes to These Terms

We may revise these Terms from time to time. The current version will always be published on our website with the effective date noted above. If you have a matter currently in progress with us, any material changes will be communicated to you directly before they take effect in relation to your engagement.
